AGENTS.
The Come Sale Away for a Big Payday Sweepstakes (“Sweepstakes”) is sponsored by The Jim
Allen Group (“JAG”) of Howard Perry and Walston Realty Inc. (“HPW”).
1. Definitions:
a. JAG Listing
Any real property advertised for sale by any member of JAG, including unimproved
land sales.
b. Qualified Closing
The JAG Listing must close with conveyance of title recorded with the register of
deeds in the county where the property is located by midnight on 12/31/2024.
c. Eligible Agents
Any real estate broker with a Qualified Closing whose license is on active status with
the North Carolina Real Estate Commission at the time of the Qualified Closing and
the Sweepstakes drawing.
2. Eligibility: The Sweepstakes is only open to individuals who are licensed North
Carolina Real Estate brokers and reside in North Carolina.
3. Submission Guidelines:
a. Each Eligible Agent who (i) represented a Buyer, or Seller as a subagent, in
the transaction and (ii) whose broker license is on active status with the North
Carolina Real Estate Commission during the Sweepstakes period will
automatically receive an email after settlement to the email address provided
in the property transaction documents. This email will contain these terms and
conditions and a survey. The Eligible Agent must then (i) agree to the terms
and conditions, (ii) verify that they meet eligibility and submission
requirements and (iii) complete the survey to receive their entry into the
Sweepstakes.
b. The Sweepstakes period begins at 12:01 am EST on January 1, 2024, and ends
at 12:00 am EST on December 31, 2024.
c. Limit to one entry per person, per Qualified Closing. Participation in the
Sweepstakes constitutes the individual’s full and unconditional agreement to
these Official Rules and Sponsor’s decisions, which are final and binding in
all matters related to the Sweepstakes. Winning a prize is contingent upon
fulfilling all requirements set forth herein.
4. Winner Notification and Sweepstakes:
a. Sponsor’s representative will randomly select Three (3) winner(s) from among
all eligible submissions received during the Sweepstakes period. The selected
winners will be considered potential winners, subject to verification and
compliance with these Official Rules. The confirmed winners will be notified
and awarded as follows:
i. A random drawing of successful Sweepstakes submissions will be
conducted at an event scheduled for February 2025. Specific details on
the time and place of the event will be given to Eligible Agents at a
later date.
ii. The selected winners must be present at the February 2025 event to
win. If the selected winners are not present, the prize will be deemed
forfeited by that person, and an alternate submission will be randomly
selected. In the event a selected winner is unable to attend due to
critical illness or hospitalization, the selected winner will be awarded
the prize, despite their absence.
5. Prizes:
a. Three separate drawings in the Sweepstakes will occur.
b. The prizes will be paid by check to each confirmed winner in a reasonable
timeframe upon the confirmed winner providing necessary tax forms (W9) and
information to Sponsor.
c. Any prize awarded is non-transferable by the recipient.
d. The confirmed winners are responsible for the payment of taxes and fees
associated with the prize.
6. General Conditions
a. Sponsor reserves the right to terminate or modify the Sweepstakes for any
reason in its sole discretion.
b. By choosing to enter the Sweepstakes, entrants agree that all disputes, claims,
causes of action arising out of or connected with the Sweepstakes, or any
prizes awarded, shall be resolved individually without any form of class
action.
c. By choosing to participate in the Sweepstakes, entrants agree to be bound by
these Terms and Conditions and agree that:
i. JAG/HPW and their designees and assigns shall have the right and
permission to use, unless prohibited by law, the winner(s) name,
photograph, likeness, statements, biographical information, voice and
address (city and state), in all forms of media, in perpetuity, without
further notice, permission or compensation; and
ii. JAG/HPW and their designees and assigns and all of their
respective officers, directors, employees, representatives, and agents
shall have no liability and entrant will indemnify, defend and hold
Released Parties harmless from any liability, loss, injury, or damage to
entrant themselves or any other person or entity, including personal
injury, death or damage to personal or real property, to entrant or any
other person or entity due in whole or in part, directly or indirectly, by
reason of the acceptance, possession, use or misuse of the Prize,
including any prize activity or travel related thereto, or participation in
the Sweepstakes; and
iii. If an entrant wishes to revoke their submission into the
Sweepstakes, the entrant must notify Robert Weisenberger
(bob@jimallen.com), in writing of their intent to remove their
submission from the Sweepstakes. Sponsor will confirm in writing
once the removal of the submission is made.
iv. By choosing to participate in this Sweepstakes, an entrant’s
personal identifiable information (“PII”) may be accessed by Sponsor.
Sponsor agrees to: (i) use such PII for business purposes only, (ii) take
reasonable steps to safeguard and protect each entrant’s PII from
unauthorized disclosures or uses, (iii) provide entrants with prompt
and sufficient notice of any and all unauthorized access and/or theft of
their PII.
d. Any Term or Condition of the Sweepstakes that violates Federal or State law
is hereby void and subject to modification by Sponsor in its sole discretion.
e. Entries and results of the Sweepstakes will be reviewed and verified by
Thomas, Judy and Tucker, Certified Public Accountants.
f. The laws of North Carolina shall govern this Sweepstakes, and any disputes
arising shall be resolved in Wake County, North Carolina by arbitration
proceedings as set forth in N.C.G.S. § 1-569.1 et al.
g. Participants are solely responsible for any costs, taxes and expenses associated
with participation in the Sweepstakes and should consult appropriate
professionals, including an attorney on how to proceed, and should not rely on
representations made by Sponsor.
h. In the event of inadvertent errors in the structure of, or printing of materials
used in connection with this Sweepstakes, Sponsor reserves the right to
terminate or amend this Sweepstakes, in whole or in part, without prior
notification and with immediate effect. In any such event, the prizes may be
awarded based on submissions received prior to date of termination or
amendment.
i. Sponsor and its agents are not responsible for computer system or phone line
errors, software/hardware malfunctions, or other errors, failures, or delays in
transmission that are human, mechanical, or technical in nature, or any
combination thereof resulting from a participant entering or being notified in
any part of this Sweepstakes.
Odds: Odds of winning depend upon the number of submissions received.
